Who is assessed for an extreme hardship waiver?

Generally to the qualified family member (for example the spouse or citizen or resident father or mother), because the law requires demonstrating the difficulty that that person would suffer. In some cases other family members are also evaluated.

What is the process like?

One or more clinical interviews are scheduled with a licensed, bilingual therapist. From them, a professional report is written that documents your emotional state and is given to you and your lawyer to present as evidence in your case.

Does it guarantee that the exemption will be approved?

No. The decision always lies with the immigration authority. The evaluation provides solid and well-founded clinical evidence to support the extreme difficulty alleged in your request.
